These Terms of Use ("Terms") govern your use of Qipasa and all associated services provided by Qipasa, Inc. ("Qipasa," "we," "us," or "our"). By using Qipasa, you agree to these Terms, as well as our Community Guidelines and Privacy Policy. If you do not agree to these Terms, you may not use Qipasa.
2- Age and legal capacity
Don’t use Qipasa if you’re under the age of 16. To use Qipasa's Wallet and money transfers, you need to have legal capacity or parental/guardian consent.
3- Your Content
You're responsible for your content on Qipasa and must have the necessary rights for any copyrighted content. Be aware that Qipasa is a social media application focused on travel and lifestyle. Stay on topic with your content. We may remove violating content (including ads) and suspend or terminate your account if you repeatedly break our rules. By posting, you grant Qipasa a worldwide license to use, modify, and display your content.
4- Intellectual Property
Qipasa respects the intellectual property rights of others, and we expect our users to do the same. You may not post any content on Qipasa that infringes on the intellectual property rights of others.
5- Safety and Privacy
Qipasa strives for a safe and respectful community. You must not engage in any activity that risks yourself or others, including bullying, harassment, hate speech, or sharing personal information without consent. You also agree to follow our Privacy Policy, which outlines our handling of your personal information.
6- Your Account
You're responsible for your account's security and activity. Qipasa can suspend or terminate your account without notice. Provide accurate and complete information when creating and updating your account. Keep your login details confidential and inform Qipasa if you suspect a breach.
7- Termination and Suspension
Qipasa may terminate or suspend your account at any time, with or without cause or notice. If we terminate your account due to a violation of our Terms or Community Guidelines, you may not create a new account without our prior written consent.
8- Disclaimer
Qipasa is a social media platform where users can share and interact with content. We strive for a safe community, but can't guarantee content's accuracy, completeness, or reliability. We're not responsible for users' posts and don't endorse them, and are not liable for damages or losses from using our platform. By using Qipasa, you agree to hold us harmless from any claims and agree to updated terms. Qipasa reserves the right to modify or discontinue aspects of our platform or update our Terms of Use at any time.
9- Digital Wallet and Payments
Qipasa offers a digital wallet feature for funding accounts and purchasing items/services. We do not offer subscription-based services. Instead, our pro-membership is paid either once or periodically, depending on the limit you set on your wallet. The payment is automatically deducted from your wallet, and you have the flexibility to set your own limit. Payments made through the platform are final and non-refundable, except as required by law. Qipasa is not responsible for payment disputes, product/service quality, or safety. Users are solely responsible for their actions on the platform, and Qipasa is not liable for any losses or damages resulting from disputes or issues. Users must comply with applicable laws and regulations and Qipasa's terms of use. Qipasa reserves the right to suspend or terminate user accounts for violations or fraudulent/illegal activities. Users should use the feature at their own risk and protect their personal/financial information. A minimum balance of €50 is required for a withdrawal request.
10- Refund Policy for Qipasa
Qipasa does not offer refunds for purchases made on the platform. All transactions are final and non-refundable, except as required by European law. For more information we refer to our Refund Policy for Qipasa
11- Limitation of Liability
Qipasa is not liable for any damages resulting from your use or inability to use the platform. We are not responsible for third-party conduct or content, and do not guarantee availability or user satisfaction. We are not liable for indirect, incidental, or consequential damages, including loss of profits or data, resulting from your use of the platform.
12- Modification of Terms
Qipasa can change these terms at any time and will post the updated version on their website. Your continued use of Qipasa after the updated terms are posted will mean that you agree to the changes.
13- Governing Law and regulations
Qipasa will comply with privacy laws and regulations in the European Union. You have the right to access, control, and delete your personal information. By using our app, you agree to our Privacy Policy and the collection, use, and sharing of your personal information.
14- Miscellaneous
These Terms are the full agreement between you and Qipasa and control your use of Qipasa. If any provision is deemed invalid, the other provisions will remain in effect. Our failure to enforce any provision will not be considered a waiver, and you cannot assign these Terms without our written consent. We reserve the right to assign these Terms without your consent.
15- Complaints and Disputes
Qipasa is committed to a fair and timely process for addressing any issues or concerns raised by our users. Users should first contact our customer support team via email at info@qipasa.com for any complaints or questions. If unsatisfied, a formal complaint can be submitted via our website at www.qipasa.com. We will conduct a thorough investigation and provide a written response within a reasonable time frame. Disputes should be resolved amongst parties first, but can be submitted through our website if necessary. Our goal is to provide a transparent and effective resolution process for our users.
